Below is the judgement copy on a case in which a girl hardly 19 years of age, stabbed her father thrice on his stomach, in-order to protect her modesty and life when the deceased exhibiting animal behavior violently attempted to rape her and kill her at knife point.
Hon. Justice S. Nagamuthu gave a historical judgement quoting the Right of Private Defence and refers to section 100 of IPC. He also says few words about the investigating officer and his investigation methods which is quite important to read in this judgement.
He quotes in point no. 13 – In the case on hand, what was attempted to be done to the petitioner was an unbearable and intolerable violence. Thus the petitioner was justified in killing her father or otherwise, she would have fallen victim of rape or in the effort she would have lost her life. In this view of the above, I am inclined to quash the proceedings.
Full judgement attached.
Thanks to Hon. Justice S. Nagamuthu to have given such a fair judgement.

The draft Bill being considered by the Women and Child Development (WCD) ministry for socio-economic upliftment of homemakers is actually an impediment and not empowerment, say many women’s groups in the city.
As per the recent proposal, husbands will be required to deposit 10-20 per cent of their monthly salary in a bank account which has to be opened in their spouses’ name as a fixed monthly salary.
Though folks like Nagamma, a domestic help are elated at the thought of “having a regular income from her drunkard husband” and women like homemaker Shantha Rangasamy are happy “finally they will get some money for their daily routine,” many are of the opinion that insisting the husbands to pay may make it ineffective.
“It is nothing but a patriarchal decision that again makes women dependent on their husbands,” says women’s right activist Ms Nirmala Kotravai. “If the idea is to empower housewives, we are once again falling back on the man’s income. It is the government which should foot the bill and not the husbands,” says the founder of women’s organisation MASES.
Ms Sheelu, president of Women’s Collective, agrees, “If the government pays farmers who are producing food for the country, what’s wrong in paying women who rear the future citizens of the country?” There is no doubt that the value of household work should be recognised but the Bill in this form will only end up spoiling spousal relationships, she says.
Ms Leena Manimekalai, a poet and independent filmmaker says, “Salaries from husbands reinstates patriarchal values and endorses the role of a wife as a ‘sexual slave’. Women can be liberated from the tyranny of the family only when governments step in. This bill insults women and re-appropriates them as a family property.”
The Bill, meanwhile, has already evoked some jokes from the men: “This will at least ensure that some money is left for me as my wife takes away the entire salary and gives me only a daily allowance.”
I got to know about this brutal act via an Email.
M. Kaliammaal from Thoothukudi demands CBI probe.
Marrying Maternal Uncle is a part of Indian Custom. Accordingly Kaliammal had married her daughter Guru Eswari to her own brother Murugan (the maternal uncle). The couple have 2 children. Murugan works in Military as “lans nayak”. Her daughter Guru Eswari is an extremely pretty looking girl and that has caused her enough trouble. Murugan was always suspicious, so he was not comfortable leaving her alone during his out station travel. Whenever he comes to his house for holiday he would shave Eswari’s head completely and ensure that she does not look pretty. Eswari did not share this with Kaliammal, instead she managed to say that its offering to GOD for the well being of her ‘Maama’ (Husband). Later the news had leaked out, Eswari got separated and lived sepeartely for some time.
Again she united with him after some panchayats. Eswari had been staying with her grand mother (Kaliammal’s mother). One day another brother of Kaliammal (i.e Murugan’s brother) visited this house and was attracted towards Eswari. He tried Molesting her. Eswari opposed to it and also told her grand mother. The grand mother does not like Eswari so she ignored it. The brother had told her Husband that Eswari was attracted towards him and she invited him to Bed.
Already suspicious character Murugan got wild, both the brothers had stripped Eswari, pushed her on a table, tied her hands & legs. They inserted a powder made of Salt, Ash, Chilly Powder and Chunar. They heated an Iron rod and inserted that into her vagina and also tortured with that all over her body. They had shut her mouth with pieces of cloth.
Later they called Kaliammal and told her that her pampering had spoiled Eswari and called her to sign an agreement. When she came down, they repeated the same brutal act on her. She was after-all their sister. They switched on F.M radio to cover the noise. The whole scene was witness by their mother. (Mother of all 3). Kaliammal fainted.
Later when she woke up there was no body and hence she managed to escape and thought of committing suicide. But she wanted to teach lesson to those animals. The neighbours could not recognise her, they thought she was mad. One of her friend vasanthi recognised her and offered help. She shouted to offer help for her daughter who was inside the house. Then many people ran into the house and checked. “My daughter was fighting for life. If I had not escaped they would have killed both of us” says Kalliammal. Both the brothers have escaped. They tried for compromise through various People. But Kaliammal and Eswari did not give up. Now they are threatening to kill them. They are sending out messages through another brother Ganesan saying that they will kill her son Kanagavel.
With a help of a lawyer brothers are filing false cases on them. Already there are about 7 cases filed on Kaliammaal and Eswari on account of petty things. She doubts that the local police is also on the brother’s side. The brothers have already kidnapped two grandsons. There are dangers to the two women’s life and Police is not taking any action against the brothers.
Hence She wants CBI investigation.
When my Mangalsutra was cut by the priest in Aravan Temple and when I embraced widowhood, I was extremely sad. SMILING OUTSIDE, DYING INSIDE! Is this our fate? Why should our life be sealed? Why should it be? We also deserve to live like any other woman. We also deserve love, deserve a family. Isn’t that too much to ask? That is the reason I want to conduct SWAYAMVARA FOR TRANSWOMEN.
I would like to partner with student groups, Rotary or Lions clubs and other support groups to conduct the historical ‘Thirunangai Swayamvara’ திருநங்கை சுயம்வரம் event. Please write to me: firstname.lastname@example.org
